Terms of Service
These Terms govern your use of APsurance.com and any insurance services provided by Alex Prato d/b/a APsurance ("APsurance," "we," "us"). By using the site or submitting the intake form, you agree to these Terms.
01 Acceptance of these terms
By accessing APsurance.com, submitting the intake form, or otherwise engaging with us by phone, text, or email, you confirm that you are at least 18 years old and that you accept these Terms and the Privacy Policy below. If you do not agree, please do not use the site or submit the form.
02 Services we provide
APsurance is an independent insurance brokerage operated by Alex Prato, a state-licensed health insurance agent (NPN 20477480), CMS FFM certified for plan year 2026, and licensed in 34 states. We help consumers compare and enroll in qualified health plans (QHPs) on the federal and state Affordable Care Act Marketplaces, as well as ancillary products where appropriate.
Our services include subsidy estimation, plan comparison, enrollment assistance, and ongoing support for the life of your policy. We do not underwrite or issue policies; carriers do that.
03 APsurance is not a government website or service
APsurance.com is owned and operated by a private licensed insurance agency. It is not affiliated with, endorsed by, or operated by the U.S. Department of Health and Human Services, the Centers for Medicare & Medicaid Services (CMS), HealthCare.gov, or any state Marketplace. For free official information, visit HealthCare.gov.
04 Eligibility, accuracy of information
To receive a quote or enroll, you agree to provide complete and accurate information about your household, income, and coverage situation. Subsidy estimates and plan recommendations are only as accurate as the information you provide. Final eligibility determinations are made by the Marketplace, not by APsurance.
If your circumstances change during the application or enrollment process, you agree to notify us promptly so we can update your file with the Marketplace.
05 How we are compensated
Our services are free to you. APsurance is compensated by insurance carriers in the form of commissions when a client enrolls in a plan. Commission rates are set by the carrier and are not added to your premium. You pay exactly the same price for a plan whether you enroll through APsurance, directly with the carrier, or on HealthCare.gov.
We may receive nominal training or marketing support from carriers. We do not accept compensation that is conditioned on selling a specific plan, and we are obligated to recommend plans based on your needs rather than on agent compensation.
06 Communications and TCPA consent
When you submit the intake form, you authorize APsurance and its licensed agents (NPN 20477480) to contact you by phone, text message (SMS), and email regarding health insurance options, even if your number is on a state or federal Do Not Call registry. Consent is not a condition of purchase.
- Message and data rates may apply.
- Message frequency varies based on your inquiry.
- Reply STOP at any time to opt out of text messages. Reply HELP for help.
- You may withdraw email or phone consent by replying to any message from us or contacting [email protected].
07 No medical, legal, or tax advice
Information provided by APsurance, whether on the site or in conversation, is for the purpose of helping you understand health insurance options. It is not medical, legal, accounting, or tax advice. The Premium Tax Credit (subsidy) reconciles on your federal tax return; consult a tax professional for personalized advice. For medical questions, consult a licensed clinician.
08 Disclaimers
The site and our services are provided on an "as is" and "as available" basis. We make commercially reasonable efforts to keep the information accurate, but plan details, premiums, networks, formularies, and subsidy amounts are set by carriers and the Marketplace and can change. Always confirm final plan details on your Marketplace application and carrier-issued documents before relying on them.
09 Limitation of liability
To the maximum extent permitted by law, APsurance, its owner, and its representatives are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site or our services, including without limitation lost profits, lost data, or interruption of service. Our total aggregate liability for any claim relating to the site or our services will not exceed one hundred U.S. dollars ($100), which the parties agree is a reasonable allocation of risk in light of the fact that no fees are charged to you.
Nothing in this section limits liability that cannot be limited under applicable law, including liability for gross negligence, fraud, or willful misconduct.
10 Indemnification
You agree to indemnify and hold harmless APsurance from any third-party claim arising out of (a) information you knowingly submitted that was false or misleading, (b) your violation of these Terms, or (c) your violation of applicable law in connection with your use of our services.
11 Intellectual property
The APsurance name, logo, site copy, design, and code are owned by Alex Prato or licensed to him. You may not copy, reproduce, or create derivative works from the site without prior written permission, except for ordinary personal browsing or for sharing a link.
12 Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. The parties agree to attempt in good faith to resolve any dispute informally first. Any unresolved dispute will be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to personal jurisdiction there.
13 Changes to these terms
We may update these Terms from time to time. Material changes will be noted by updating the "Last updated" date at the top of this page. Your continued use of the site after a change constitutes acceptance of the revised Terms.

Privacy Policy
This Privacy Policy explains what information APsurance collects, how we use it, who we share it with, and the choices you have. We collect what we need to help you, nothing more.
01 Overview
APsurance ("we," "us") collects personal information to provide insurance brokerage services. We follow applicable federal and state privacy laws, including the Gramm-Leach-Bliley Act (GLBA) for financial information, the Telephone Consumer Protection Act (TCPA) for communications, and applicable state privacy statutes including the Florida Digital Bill of Rights and the California Consumer Privacy Act (CCPA) where they apply to you.
02 Information we collect
We collect information you give us directly when you fill out the intake form, request a quote, or correspond with us:
- Contact details: first name, last name, phone, email, ZIP code.
- Eligibility details: reason for seeking coverage, household size, estimated household income, state of residence.
- Enrollment information (only if you choose to enroll): date of birth, Social Security number, citizenship/immigration status, tax filing status, and any other information required by the Marketplace to determine eligibility and process your application. This is collected through secure Marketplace channels, not through the public site.
- Communications: records of phone calls, text messages, and emails between you and APsurance.
- Technical data: IP address, browser type, device type, pages visited, and basic analytics about your session on the site.
03 How we use your information
- To estimate your subsidy and recommend appropriate plans.
- To contact you by phone, text, and email about your inquiry, as authorized in the intake form.
- To submit your enrollment to the Marketplace and the chosen carrier, with your permission.
- To service your policy throughout the plan year (renewals, life-change updates, support).
- To comply with CMS rules, state insurance regulations, and applicable law.
- To maintain and improve the site, and to measure aggregate marketing performance.
05 We do not sell your data
APsurance does not sell or rent your personal information to third parties for their marketing. We do not share your leads with other agents or "lead aggregators." Your intake submission goes to Alex Prato directly.
06 Cookies, analytics, and ads
We use a small number of cookies and similar technologies for basic site functionality and for measuring aggregate visitor activity (such as Google Analytics or a comparable provider). We may use conversion pixels to measure the effectiveness of advertising on platforms like Meta. These tools collect technical data and behavior on our site, but we configure them, where available, to limit personal-data sharing.
You can opt out of most analytics and advertising cookies through your browser settings or via industry opt-out tools at aboutads.info and networkadvertising.org.
07 How we protect information
We use commercially reasonable physical, technical, and administrative safeguards to protect personal information. This includes encrypted transmission of form data, access controls, and limiting personal-information handling to Alex Prato and vetted vendors. No system is perfectly secure; if a breach affects you, we will notify you as required by law.
08 How long we keep it
We keep your information for as long as you remain an active client and for the period required by CMS, carriers, and state insurance regulators after your policy ends (generally 7–10 years for enrollment records). Intake submissions that do not result in enrollment are typically purged within 24 months unless you ask us to keep them longer.
09 Your rights and choices
Depending on the state you live in, you may have the right to:
- Request a copy of the personal information we hold about you.
- Correct inaccurate information.
- Request deletion of personal information that we are not legally required to keep.
- Opt out of marketing communications (reply STOP to texts, unsubscribe from email, or email us).
- Designate an authorized agent to make a request on your behalf.
To exercise any of these rights, email [email protected]. We will respond within 45 days, or as required by applicable law.
10 Children
The APsurance site and intake form are intended for adults 18 and over. We do not knowingly collect personal information from children under 18 directly. Enrollment information about minor dependents is provided by the adult policyholder during the Marketplace application.
11 HIPAA notice
As an insurance broker assisting with enrollment, APsurance is not a "covered entity" under HIPAA. We may, however, receive limited protected health information (PHI) in the course of helping you choose a plan. We treat that information with the same care as other sensitive financial information described in this Policy and only use it to help you select and enroll in coverage.
12 Changes to this policy
We may update this Privacy Policy from time to time. The "Last updated" date at the top of this page will reflect the most recent change. Material changes will be highlighted with a notice on the site for at least 30 days.
